07/18/2007 | Early Installation of Curb, Gutter and Binder Course Approved
The Village Board approved an amendment to a development agreement with Regency Hills – Creekside Crossing, LLC allowing for early installation of a curb, gutter and binder course of pavement at its June 18 meeting. The original agreement between the developer and the Village required that 50% of the condominium housing units in the development be complete prior to installation of the curb, gutter and binder course.
An exception that the Village requires of the developer, when agreeing to early installation, is financial responsibility on the part of the developer for any damage that may occur to the curb, gutter and binder course prior to completion of the development.
In a slower housing and construction market it takes more time to meet the minimum percentage of completed units. In an effort to allow new homeowners to proceed with installation of lawns, landscaping and paved driveways the Village will sometimes come to an agreement with the developer allowing for an earlier installation of the curb, gutter and binder course of pavement. Earlier installation of lawns aids in erosion control and allows the homeowners to collect their $1000 Erosion Control Deposit more quickly.
The Village Board approved a similar agreement with Village Green Condos, LLC to allow early installation of the curb, gutter and binder course adjacent to two condominium buildings, with financial responsibility for any necessary repairs or replacement resting with the developer.
